Personal Injury Compensation After a UK Road Accident — Full Guide

Any road user — driver, passenger, cyclist, motorcyclist or pedestrian — who is injured because of someone else's negligence can claim compensation in the UK. The process depends on the nature and value of the injury, and the 2021 whiplash reforms changed the landscape considerably. This guide walks through both the low-value tariff route and the traditional personal injury route.

Who can claim?

  • Drivers and passengers in cars, vans, taxis, buses, coaches
  • Motorcyclists and pillion passengers
  • Cyclists
  • Pedestrians
  • Children (through a litigation friend)

Common injury types

  • Whiplash and other soft-tissue neck/back injuries (see our whiplash guide)
  • Concussion and mild traumatic brain injury
  • Fractures (arm, wrist, ankle, ribs, pelvis)
  • PTSD and psychological injury
  • Scarring and permanent disfigurement
  • Serious life-changing injuries (spinal, brain, amputation)

The two claim routes

Official Injury Claim (OIC) portal — under £5,000

For whiplash-only claims worth under £5,000 in England or Wales. Compensation on a fixed tariff. Self-represented in most cases.

Traditional personal injury route

For:

  • Injuries worth over £5,000
  • Non-tariff injuries (fractures, PTSD, serious back injury)
  • Mixed injury claims
  • Children (under 18) and protected parties
  • Motorcyclists and cyclists

Typically handled by a regulated solicitor on a No Win No Fee agreement.

What personal injury compensation covers

  • General damages — for pain, suffering and loss of amenity
  • Loss of earnings — including future losses for permanent injury
  • Medical treatment and rehabilitation — private physio, surgery, psychology
  • Care and assistance — including unpaid care by family
  • Aids and equipment — home adaptations, mobility aids
  • Travel and transport — including specialist vehicle costs

The medical report

Every personal injury claim needs an independent medical report. For OIC portal cases, this comes from a MedCo-registered expert. For higher-value cases, more than one specialist may be needed.

No Win No Fee

Most personal injury solicitors work on a Conditional Fee Agreement (CFA):

  • No fee if you lose (subject to conduct rules)
  • Success fee capped at 25% of general damages if you win
  • After-The-Event (ATE) insurance often used to cover disbursements

Timeline

  • Straightforward OIC whiplash: 4–9 months
  • Traditional soft-tissue claim: 6–15 months
  • Serious injury: 2–5 years (often with interim payments)

Limitation

Three years from the date of the accident (or knowledge of the injury). Two years for MIB claims. Different rules apply for children (three years from age 18).

How VIP Claims fits in

We work with regulated personal injury specialists. If you have suffered any injury we can refer you and handle the vehicle-side claim in parallel — repairs, hire vehicle, and property damage.

Talking to VIP Claims is free and puts you under no obligation. We are an independent, UK-based accident management company — not an insurer. If your accident wasn't your fault, we can arrange a like-for-like replacement vehicle, manage repairs at an approved bodyshop, and recover all costs from the at-fault driver's insurer, protecting your no-claims bonus and keeping your excess in your pocket. Frequently asked questions

How long do I have to make a personal injury claim?
Three years from the date of the accident (or knowledge of the injury) in most cases. Two years for MIB claims. Different rules for children.
Do I need a solicitor?
For OIC portal whiplash claims under £5,000, no. For higher-value or complex injuries, yes.
What does No Win No Fee mean?
A Conditional Fee Agreement: no fee if you lose, and a success fee (capped at 25% of general damages) if you win.
Can I claim if I was a passenger in the car at fault?
Yes — you claim against the driver's insurance, and that's true even if it was your friend or partner driving.
Can I claim if I was partly at fault?
Yes, subject to a proportional reduction for contributory negligence.
How much personal injury compensation will I get?
Anywhere from a few hundred pounds for minor tariff injuries to hundreds of thousands for serious life-changing injury.
What if my injuries get worse later?
Report to your solicitor immediately; you can seek an updated medical report and, if the case hasn't settled, additional compensation.
Does an injury claim affect my insurance?
A non-fault injury claim usually has less impact than a fault claim; insurers can still record it, so declare accurately at renewal.
